General terms and conditions for TUI fly Gift Voucher

Scope of application

These general terms and conditions are applicable to the purchase of the TUI fly Gift Voucher as well to its use by the beneficiary. By ordering and using one or several TUI fly Gift Vouchers you accept the applicability of the present terms and conditions.

Order

Since 17/08/2021 it is no longer possible to purchase a TUI fly gift voucher.

Payment

The order has to be paid immediately. Payment can be made online. The SSL technology guarantees safe online payment.

We make use of the latest SSL technology (Secure Socket Layer) to secure your payment information and other confidential information if you place an order via www.tuifly.be.

At this moment SSL is the safest method for sending payment data or other confidential information via the Internet. If your browser supports SSL, it is sufficient to select the option ‘Safe mode’ when you want to confirm the reservation. Your payment information and your personal data will then be secured by this technology. If the possibilities of your browser are limited, you can use the unsecured mode. However, we advise you to update your browser to the most recent version or to use a browser which allows you to perform transactions via the internet without worries.

The secured software (SSL) ensures that all sensitive information, including personal and payment information, can only be exchanged between yourself and TUI fly and that third parties do not have access to these data.

All information relating to your payment, name and address are saved on a secured server. After completion of the transaction we do not keep any personal data of customers nor any payment information on our web servers. This means you have to re-enter the data every time you book via the Internet.

Delivery

When ordering via the internet your gift voucher is sent by e-mail after receipt of your payment. The TUI fly Gift Voucher is exclusively issued electronically (pdf format).

Validity and use

The TUI fly Gift Voucher mentions a date of issue, an activation code and a period of validity. The Gift Voucher is valid for flights that take place within 12 months of issue date. There is no extension possible.

The TUI fly Gift Voucher can be used as (partial) payment of a trip from theTUI fly offer, provided that the general and specific travel terms and conditions applicable at that time are accepted. The value of the Gift Voucher cannot be deducted from the price of a trip already taken or already booked.

Each Gift Voucher can only be used once. As soon as the TUI fly Gift Voucher is used as (partial) payment of a TUI fly booking, it is no longer valid.

TUI fly Gift Vouchers are not issued in a particular name. They can therefore be passed on to someone else without any problems.

The TUI flyGift Voucher cannot be converted into cash and cannot be exchanged for another TUI fly Gift Voucher for the amount mentioned or for part of this amount.

Loss or theft of one or several gift vouchers

In case of loss of one or several Gift Vouchers during or after their dispatch, you should immediately report this loss to TUI fly, so that the Gift Vouchers that were lost can be cancelled. Upon your request these Gift Vouchers will be replaced by other gift vouchers, the validity of which expires on the same date as the original vouchers. For each Gift Voucher an amount of € 12.50 will be charged for additional administrative and dispatch costs.

Right of retraction

In case of distance sale the consumer is entitled to cancel the purchase without indication or reasons and without payment or any fine, and to recover the purchase price.

If you want to assert this right, you should inform us in writing within 14 calendar days after receipt and confirm that you deleted/destroyed theTUI fly Gift Voucher(s) as well as all copies. You can no longer assert this right if you forwarded the Gift Voucher(s) to another beneficiary.

Privacy

Agreement relating to privacy protection (Act of 08.12.1992).

TUI fly is a protected brand name of N.V. Tui Airlines Belgium, Gistelsesteenweg 1, 8400 Oostende, which is responsible for the processing of your personal data.

Your personal data are requested with a view to sending you our TUI fly Gift Voucher, being able to provide adequate services and/or drawing up a legal travel contract between yourself and N.V. Tui Airlines Belgium, as well as registering your TUI fly booking in our reservation system. Only the data that are necessary for that purpose are requested. You are entitled not to enter your personal data. This means that you waive the possibility to order a Gift Voucher or book a trip via the TUI fly website.

N.V. Tui Airlines Belgium will only use the collected personal data for the processing of your reservation with TUI fly, and not for other purposes. This means that their processing is subject to professional secrecy as described in the travel legislation.

You are at all times entitled to have access to these data, correct them or object to their use. You can address your written request to N.V. Tui Airlines Belgium at the above-mentioned address.

Liability

TUI fly is a brand name of N.V. Tui Airlines Belgium, Gistelsesteenweg 1, 8400 Oostende. N.V. Tui Airlines Belgium cannot be held liable for any damage, except if the damage was caused by a gross error or wilful misconduct of N.V. Tui Airlines Belgium or its employees.

N.V. Tui Airlines Belgium is not responsible for:

• misunderstandings, delays or the inadequate transmission of orders and messages as a result of the use of the Internet or any other means of communication within the framework of the relation between yourself and TUI fly
• misuse of the TUI fly Gift Vouchers by third parties

Applicable law and jurisdiction

Disputes are exclusively governed by Belgian law. Only the courts of Brugge have jurisdiction.
